Se ordenó provisionalmente suspender los efectos de la Sentencia proferida por el Juez de la referencia, la Corte también ordenó al ICBF remitir toda documentación que forme parte de la etapa previa a la demanda del proceso de adopción, por cuanto la reserva no incluye tal etapa, así como, la información si hubo o no Sentencia Judicial proferida por el Juez de Familia concediendo la adopción de la menor xx.

  1. PRIMERO. Provisionalmente ORDENASE suspender los efectos de la Sentencia proferida por el Juez
  2. Tercero. del Circuito de Barranquilla del 21 de abril de 1995. Posteriormente, dentro de los terminos legales, esta Corte decidira sobre los fallos objeto de revision.
  3. SEGUNDO. ORDENASE al Director del Instituto Colombiano de Bienestar Familiar -Regional Atlantico, en el termino improrrogable de veinticuatro horas remitir a la Corte Constitucional, Sala Septima de Revision (Calle 72 Ndeg 7-96 Santafe de Bogota) la constancia correspondiente que senale si hubo Sentencia Judicial dentro del proceso de adopcion de la menor XX, asi como tambien el Juzgado que la profirio, y cuando quedo en firme tal fallo, si lo hubo.
  4. TERCERO. ORDENASE al Director del Instituto Colombiano de Bienestar Familiar Regional Atlantico, en el termino improrrogable de veinticuatro horas remitir a esta Sala de Revision las fotocopias correspondientes de la actuacion previa, es decir desde que la menor XX ingreso al centro de proteccion hasta la Resolucion de declaratoria de abandono. Protegiendo los nombres de los padres adoptantes y la localizacion de la menor.
  5. CUARTO. NOTIFIQUESE esta decision, para su cumplimiento, al Juez
  6. Tercero. Penal del Circuito de Barranquilla, al Director del Instituto Colombiano de Bienestar Familiar Regional Atlantico, y COMUNIQUESE a la peticionaria.
  7. Ordenese la suspension de terminos a partir del recibo del presente Auto.
